I think its important to share our experiences. And with interviewing a former drug cop for the latest show, and The THC Media Network giving away a few of Barry Cooper's DVD's soon, I wanted to include this info finally. And share with you all some intimate details of my life in this past year. If you have any questions or want any more info divulged. NARRATIVE
ILL NARRATE THIS THING WITH A LITTLE ADD IN.THEY AREN'T FULLY TRUTHFUL. THOSE SNEAKY DEVILS. WE WILL MAKE MINE RED SO ITS EASY TO GET AT.
I HOPE YOU CAN TAKE SOMETHING FROM THIS REPORT.
NARRATIVE:
On 10-18-07 at approximately 2245 hours, members of the ACET (All Crimes Enforcement Team) and other officers executed search warrant # 07MS38, at 580 1st Ave West #5 Craig, Colorado, the residence of Timothy (Tim) Michael Martin.
TFO Wiggins knocked and announced our presence and advised that we had a search warrant.
IN OTHER WORDS, USED A BATTERING RAM TO TAKE AT LEAST THREE MASSIVE SWIPES AT THE DOOR, THEN IT CAME CRASHING OPEN, WITH THEIR GUNS DRAWN. POINTED AT MY HEAD. BUT THAT’S JUST TOO GRIMM TO PUT IN A REPORT I GUESS. Upon entrance, we encountered Timothy Martin who was sitting on the stairway. Tim was detained, while the rest of the house was secured.
The stairs were located directly in front of the door where we made our entrance. To the left of the stairs was a kitchen and past the kitchen was a living room. Lt Hume and TFO Schulze secured these areas.
TFO Johnson, Tim Stanley and I secured the upstairs. Immediately while walking up the stairs to the second floor, I noticed a dryer hose that had warm air circulating out of the end that faced the stairway. The air coming out of the hose smelled like the raw odor of marijuana. I have worked on several cases involving raw marijuana and have come to recognize the smell of raw marijuana and burned marijuana.
Once we reached the top of the stairs we were on the second level. There was a bedroom located directly in front of the stairway. In this bedroom was a computer desk that faced the south wall, a bed lied from the south to the north and was against the east wall. A television faced in a diagonal position towards the bed, which was on a T.V stand. A closet was at the end of the bed on the north side. A coffee table sat almost center in the bedroom. This bedroom was identified as bedroom #1, for evidence collecting purposes and each item collected as evidence from this room was marked as being found in bedroom #1.
After securing bedroom #1, we continued down the hall, which walked north and south. On the right was a bathroom that contained a standup shower and a toilet. A clear glass jar containing numerous ladybugs was on a shelf in the bathroom.
GREAT BUGGERS FOR THE SPIDER MITES THEY ARE. FOR SOME REASON THE POLICE COULDN’T PIN POINT WHAT THEY WERE EXACTLY FOR. After passing the bathroom, there was another bedroom. In this bedroom there were multiple lights hanging from the ceiling, multiple green leafed plants that appeared to be marijuana plants. There was also a closet on the west side of the bedroom. In the center of the bedroom was a dresser. This bedroom was identified as bedroom #2, for evidence collecting purposes and each item collected as evidence from this room was marked as being found in bedroom #2.
After securing the entire residence, I met back with TFO Wiggins who was standing with Tim Martin. Tim was now in custody for suspicion of cultivation of marijuana. TFO Wiggins read Tim his Miranda rights and Tim stated he understood them. I read Tim the search warrant and what the search warrant entailed. Timothy said he understood. Timothy was asked if there was anything illegal that he wanted to let us know about before we began searching. Timothy said that it was obvious, referring to the marijuana plants.
WHAT THEY FAIL TO MENTION IS I SAID IT WAS ALL LEGAL. HE RESPONDED WITH.. “ALL THIS STUFF IS LEGAL?” I SAID “YES” Timothy also said anything else we were looking for would be found in a silver box located under a coffee table. TFO Johnson clarified with Timothy what table he was referring too. Timothy stated it was underneath the coffee table in his bedroom, which was bedroom #1. I asked Tim how many people lived with him.
At this point, we began searching Tim’s residence, while Tim waited in his kitchen for a transport vehicle to take him to jail. Assisting in the search was Lt Hume, who searched the downstairs, and Ken Johnson who searched bedroom #1 with me. As we began the search, I saw that Tim had a laptop computer and a desktop computer. I believed that these computers might have contained items of evidentiary value regarding the cultivation of marijuana, so I encountered Tim again. I asked Tim if he still remembered his Miranda rights and he stated that he did. I then asked Tim for consent to search his computers. Tim could not make up his mind and asked me why I wanted to search his computer. I told Tim that I was looking for items relating to marijuana cultivation. Tim then said that he did have items on his computer about marijuana cultivation, and he stated that it was not illegal for him to have those items on his computer. I again asked Tim for consent and he still could not make up his mind. The computers were seized out of bedroom #1 and a search warrant was later obtained for the computers.
WHAT HE FAILS TO MENTION HERE ALSO, IS I TOLD HIM HE NEEDED A SEARCH WARRANT FOR MY ELECTRONIC INFO ON MY COMPUTERS. AND IF HE DIDN’T HAVE ON THEY COULDN’T TAKE THEM. BOY WAS I WRONG. AND I NEVER, DID SEE A WARRANT. EVEN AFTER LOOKING THROUGH ALL THIS STUFF TO POST UP FOR YOU ALL, I NEVER SAW, NOR WAS MY LAWYER PRESENTED WITH A SEARCH WARRANT FOR MY COMPUTERS. THEY EVEN TRIED TO RUIN THEM WHILE IN THEIR CUSTODY. WHEN I RECEIVED THE COMPS BACK IN MY POSSESSION AFTER THE JUDGE ORDERED EVERYTHING RETURNED, THEY DIDN’T WORK, AND TOOK A SPECIALIST TO REMOVE THE WORMS THEY HAD ATTATCHED.
During the search of bedroom #1 TFO Johnson and I collected several items as evidence. On the computer desk, we collected various denominations of money, which totaled $1400.00 dollars.
WHICH WAS MONEY SAVED FOR THE MOVE I WAS MAKING TO DENVER A WEEK LATER. UNFORTUNATELY, NOT HAVING A BANK ACCOUNT MAKES YOU LOOK LIKE A CRIMINAL?! We also collected a $50 dollar bill located in the wallet belonging to Timothy Martin. The money was collected because it was suspected as money being gained from the illegal sale of marijuana. Also located on the desk were three baggies containing approximately 6grams of marijuana in each bag. A glass jar containing approximately 30 grams of marijuana was also found on the desk. There were also drug paraphernalia items found on this desk.
IT SHOULD ALSO BE NOTED THAT ALL MY MONEY, PLUS MONEY THEY USED TO BUY DRUGS WITH WERE RETURNED TO MY POSSESSION. BASICALLY, THEY PAID ME FOR MY TIME. SINCE THEY DIDN’T WRITE THE SERIAL NUMBERS FROM THE MONEY THEY GAVE TO THE INFORMANT THEY DIDN’T KNOW WHAT WAS WHAT. SO THE INFORMANT, WHO TOLD ME SHE WAS LEGAL MED MARIJUANA PATIENT, WAS GIVEN UNDOCUMENTED MONEY FROM A POLICE AGENCY. SCARY.
On the coffee table in bedroom #1, we collected various drug paraphernalia items and various amounts of marijuana. On the top of the coffee table was a piece of aluminum foil with marijuana joint that was packaged in plastic.
NEVER GOT THE J BACK THOUGH. Also found on the foil was a scale that contained raw marijuana residue. Underneath the coffee table was the silver box that Tim had earlier described. In the silver box were nine plastic sandwich baggies that each contained approximately 6 grams of marijuana. The baggies appeared to be packaged for distribution. Several of theses baggies found in this box had labels with different peoples
PATIENTS names on the label. The baggies labels also contained the type of marijuana that was inside the baggie.
Found in a nightstand drawer next to Tim’s bed in bedroom #1, was a Berretta 9mm handgun. The gun had a magazine loaded that contained five rounds inside the magazine.
NEVER HAD MY HAND GUN RETURNED, PER MY FELONY CONVICTION OF POSSESSION OF 8OZ OR MORE.
In the search of bedroom #2 we collected 13 suspected marijuana plants. Inside the plants, I observed there were numerous ladybugs. Two grow lights that hung from the ceiling were collected, along with one fluorescent grow light. These lights are commonly used in marijuana grows to help the plants cultivate into marijuana. Also found were an air conditioner, an electric timer/ thermometer, a fan, ballast/transformer and other various items that are commonly used in marijuana grow operations. The window in the bedroom was covered by foam type board and a black like trash bag material, which prevented sunlight to enter the room. There were several marijuana cultivation books collected.
I saw that downstairs Lt Hume collected other items as evidence. Lt Hume collected part of a marijuana plant that contained several marijuana buds. This item was found next to the entertainment center in the downstairs living room. A string was attached by duct tape from the entertainment center to a wall. This string contained raw marijuana residue. It was suspected that the part of the marijuana plant found near the entertainment center was hung to dry on this particular string, and that this string was used for hanging the grown marijuana plants to dry.
The entire residence was video recorded before searching and the items collected as evidence were video recorded. For further details on the items of evidence collected, and the location collected see the video recorded DVD, which was booked in as evidence. Photographs were also taken and will be attached to this report. A total of 35 items were seized from Tim’s residence. A copy of the search warrant return was signed and left for Tim.
THEY TORE THE PLACE UP, TOP TO BOTTOM AND THREW EVERYTHING EVERYWHERE.
Prior to leaving Tim’s residence I saw that he had two bottles of prescription pills that were recently dated with his name on the bottles. I took the two bottles to give to Tim at the Jail. The jail staff checked the pills to make sure that the pills inside the bottle matched the label. There were five white pills found in one of the pill bottles. The pills did not match the other pills. The pills were identified as vicodin pills. Tim did not have any prescription for the vicodin pills.
AHH, BUT QUITE THE OPPOSITE. AT THE TIME OF MY ARREST I DID HAVE A PRESCRIPTION; THERE WAS EVIDENCE OF IT ON AN EMPTY BOTTLE NEXT TO THE ONE WITH THE PILLS. I JUST MADE THE MISTAKE OF COMBINING MY VICODIN PILLS, TOGETHER IN THE SAME BOTTLE WITH THE IBUPROFEN VICODIN I HAD TOO. DON’T COMBINE PRESCIPTIONS IN THE SAME PACKAGE. NEITHER OF WHICH WERE HELPING WITH THE PAIN I WAS EXPERIENCING UNFORTUNATELY. BUT, THE GREEN DOES THE BEST TRICK
All of the items were later booked into evidence. I tested random samples of the marijuana collected using narco test kits. These test showed the marijuana tested positive.
While conducting debriefing, I spoke with TFO Schulze about the items found in Timothy’s apartment specifically relating to the marijuana grow. TFO Schulze advised me she has investigated marijuana grows in the past and has received training specific to indoor marijuana grows. She also told me the following:
THE FOLLOWING IS A GOOD REASON WHY POLICE SHOULD BE EDUCATED ABOUT THE DRUGS THEY ARE FIGHTING AGAINST. THE POLICE DIDN’T KNOW ANYTHING ABOUT ANY OF THE THINGS GOING ON WITH MY GROW, AND CERTAINLY THEY DON’T HAVE A CLUE ON WHY I, OR PLENTY OF OTHER PEOPLE GROW FOR MED AND RECREATIONAL PURPOSES. ITS SCARY HOW LITTLE THEY ARE TAUGHT AND KNOW. I MEAN THIS IS ALL THEY COULD COME UP WITH…
Based on her training and experience related to investigating several indoor marijuana grows, and from speaking to more experienced narcotics investigators, she knows that it is common for indoor marijuana growers to cover their windows to their grow rooms in order to protect the “photoperiod” or amount of light the plants are subjected to. Marijuana growers often keep timers on their lights to adjust the period of light required for the plants to mature. By covering the windows they are able to keep any exterior light from entering the grow rooms and altering the “photoperiod” the plants are subjected to. Windows are also covered to prevent escape of high intensity light produced by the metal halide and high pressure sodium lights commonly used in indoor marijuana cultivation. Windows are also covered to prevent neighbors or police from looking into the grow rooms and observing the marijuana and equipment used to grow marijuana indoors.
She also knows from her training and experience and speaking to more experienced narcotics investigators that indoor marijuana growers must ventilate their grow rooms due to the fact the high intensity lights being utilized create too much heat and will stunt the plant’s growth. As well, when marijuana plants are growing, they are in a state of photosynthesis whereby the plants use up the carbon dioxide in the air and give off oxygen. If left unventilated, the plants would supersaturate the grow rooms with oxygen and create a carbon dioxide starved environment, causing the plants to stop growing and die. Growers must create a ventilation system in their grow rooms to bring fresh, cool, carbon dioxide laden air into the environment while venting or exiting the hot, oxygen laden air from the grow space. It has been her experience that some growers utilize dryer hoses to blow the hot, oxygen laden air from the grow rooms. It is also common to see oscillating fans used to control the environment of the grow room. Marijuana grown indoors runs the risk of insect invasion, as an indoor grow is not kept in check by the forces of nature which help keep the insects at bay. There are typically five insects that are most likely to attack marijuana grown indoors: aphids, mealybugs, mites (actually an arachnid), whiteflies and scale. A common way to keep aphids out of indoor marijuana plants is to introduce a benign insect such as a ladybug, which is a predator to aphids. Ladybugs can be purchased commercially from insectiaries, and usually come with instructions for their use. Ladybugs go through a rapid lifecycle and may eat hundreds of aphids as they grow to adults.
She also knows from her training and experience and speaking to more experienced narcotics investigators that marijuana plants usually take up to four months to grow to full maturity. She knows that marijuana growers typically utilize 1000 watt type lights, which are used as a substitute for natural sunlight. Marijuana growers will often have miscellaneous equipment and paraphernalia such as ballast/transformers, electrical fans, thermostats, plastic bags, watering tanks, ph testing strips or equipment, fertilizers, common gardening tools, scales, and scissors. As the marijuana plant matures, the marijuana grower will trim them on an ongoing basis. This is done to facilitate a more rapid and vigorous growth of the marijuana plant(s) and to provide the marijuana growers with marijuana for their own consumption. This dried marijuana will often be kept within the residence, vehicle, and/or upon the persons of the marijuana growers themselves. Furthermore, she knows that persons who cultivate marijuana will distribute marijuana they produce to other persons for profit.
THAT’S A PRETTY BIG CAST OF THE NET THERE. ALL GROWERS THEY SAY. ALL OF ‘EM.
She has also learned that persons who grow and distribute marijuana utilize miscellaneous written documents, such as published books and magazines concerning marijuana manufacturing and sales, written records concerning the growers cultivation of marijuana, account ledgers dealing with profits and losses associated with growing/distributing marijuana, growing schedules, documents, concerning profitability and other such documents and written records.
