First off, and i think an important statement about our drug war...

The Drug task force who arrested me and DA would have allowed a misdemeanor plea if i WOULD HAVE WORKED WITH THEM, and put some of the same loving people in the same position. I made it clear, im not in the position to buy and sell human lives. Like mine was
Not a chance in the world.

Now some more explanation until i talk to you again.......Took a felony (1) and no trial because I made a mistake and was too caring for people, and let someone in my caregiver group who told me they were legal, i tried to get legal, but wasn't legal. I chose to take what i did not because of selfish reasons. Its one of those choose your own battle situations, and when and what can i do to be a pain in the ass of the Drug War, ill do it as soon as and smart as possible. 2-6 years was the sentence possible on 4 individual felonies, and i wouldn't have won a trial, in my mind, one one of the charges. i was duped and fooled, and sold out for being too trusting. The DA here is playing hardball and making green look like meth and heroin. This is sad, cause its worse in alot of other places.......

Take it as you will, my only excuse is life. And my chess move in the war.

Im sitting here happy. In my own place, in front of my two production computers that were stolen by the very people we expect to protect us. In short, (and i will re-post a local news article below explaining more), i am now a non-violent felon, and victim of the WAR ON SOME DRUGS. But i received back thousands of dollars that was seized from my possession, and the judge ordered ALL my property returned, including two ounces of marijuana, AND my computers. Which to me are priceless.

But where the story gets interesting is im the first felon in Colorado, and the first i can find anywhere in this country to be a convicted felon and receive back their medical marijuana, and I'm also allowed to continue to medicate on my 3 year probation. A huge tool medical defendants and attorneys can use in legal cases, not just in this great state of Colorado, but possibly all over the nation. The more and more i think about this, the more amazing it is to me, and my lawyer, Mr. Robert Corry. Thank you sir, by the way. There are now courts in the U.S. that are saying Marijuana is a legitimate medicine, and the people agree with this. In fact the people are the ones allowing this change in mindset to be achieved. But still we make serious dents in lives and brand some 'felons' unjustly.

I thank all of you in the community. And if you smoke the green, you are part of the community and family. Its you who are making the difference, and giving politicians like Ron Paul, Barney Frank, and Bill Richardson the ability and tools to make a change long overdue. Its frustrating to think I am a felon now, because of something that helps me. But its more frustrating to think that im not the only one.

Dont give up the fight, and DO work together on this as much as possible. Together we will achieve the goals of reform that were started over 60 years ago.

And God bless America. Both its strengths, and faults. Especially since im here for the long haul now... lol.

Judge orders medical marijuana returned to Craig man

Tim Martin, 24, of Craig, retrieved two ounces of medical marijuana Thursday afternoon from Moffat County authorities. Craig â€” Tim Martin, a 24-year-old Craig man, said he has battled a â€œwell-documentedâ€ history of severe pain caused by migraine headaches and stomach ailments for almost 10 years.
Medical marijuana, which seven months ago he cultivated in his Craig apartment for himself and others, helps alleviate that pain.
â€œThat is the only reason I use marijuana â€” for pain,â€ he said.
â€œThis medical marijuana is a right for me. Itâ€™s something that treats my illness, and it helps.â€
Backed by a court order, Martin was able to complete an unusual transaction Thursday that entailed him retrieving marijuana and items used to grow it from Moffat County authorities.
The All Crimes Enforcement Team arrested Martin in October 2007, seizing marijuana and other cultivation items from his apartment. He was charged with felony counts of cultivation, possession with intent to distribute and distribution, among other charges.
The catch: Martin was registered as a patient and caregiver at the time with the Colorado Department of Public Health and Environmentâ€™s Medical Marijuana Registry program, which allowed him to legally possess and use designated amounts of marijuana and plants and provide marijuana to other registered patients.
Under a plea agreement, five charges against Martin were dismissed. He pleaded guilty to one count â€” possession of 8 ounces or more of marijuana, a Class 5 felony.
On Wednesday, Moffat County District Court Judge Shelley Hill sentenced Martin to three years probation, 15 days in jail, 24 hours community service and to pay about $3,523 in costs and fees. He has no prior criminal history in Moffat County, according to court records.
The judge also complied with a request from Martinâ€™s attorney, Robert Corry, of Denver, and ordered the return of his clientâ€™s marijuana and other property. The 14th Judicial District Attorneyâ€™s Office objected to the drug being returned.
Martin was able to retrieve about 35 items seized from him, including two ounces of marijuana, a portable air conditioning unit, two 1,000-watt grow lamps, horticulture books, smoking pipes and a vaporizer. A handgun that was seized will not be returned to him because of his felony conviction.
Corry said law required the judge to order marijuana that Martin is legally permitted to possess be given back to him. The District Attorneyâ€™s Office had no comment.
Martin, a former media director for the local group, Communities Overcoming Meth Abuse, said his problems with the law stemmed from providing marijuana to a person who wasnâ€™t listed on the stateâ€™s registry. Admittedly, doing so was a â€œlarge mistake,â€ he said.
â€œI became too trusting of a person and was told that person was in the process of being in the program,â€ he said.
â€œThat was a mistake on my part. I take responsibility for that mistake. â€¦ Ultimately, I broke the rules. You have to follow the rules. Thatâ€™s the bottom line.â€
He was scheduled to report to jail Thursday afternoon to begin serving his sentence.
Martin said he provided marijuana to three other people who were registered with the state. Those patients suffered either from cancer or AIDS, he said.
â€œIt helps them with their nausea and pain with relatively no side effects,â€ Martin said.
Prescribed pills for his medical condition caused harsh side effects, Martin said, and prompted him to use marijuana to ease the pain.
â€œThis helps me and I have no side effects,â€ he said.
Amendment 20, passed in the November 2000 general election, tasked Public Health and Environment with implementing the Medical Marijuana Registry program. According to the department, 54 counties have registered applicants; Moffat County is listed as having less than three patients and Routt County is listed as having four patients.
Martin said he continues to use medical marijuana, but no longer grows it. He now obtains it through a caregiver, like he once was.
â€œPart of taking that responsibility was I (voluntarily) gave up my caregiver-ship,â€ he said.
Martin said he is an advocate for drug reform, specifically for more treatment in lieu of prison sentences for users. He also has worked as an unpaid volunteer for Safer Alternative for Enjoyable Recreation Colorado, a group that has campaigned for legalizing small amounts of marijuana for recreational use.
However, he said his case was not about the pros and cons of legalizing drugs, rather the court upholding rights given to him by an authorizing doctor and the stateâ€™s voters.
â€œThis is a health issue,â€ he said. â€œThis is a right given to me by a medical doctor. â€¦ It falls in line with the will of the people of Colorado. (The judge) made a fair decision, the right decision.â€
