YahooGroup too. I have been in touch with Matt Bunch, Tom Ammiano's Legislative Aide. He sent me the following reply:
Hello,
I am writing to ask a few questions abut AB390. I am starting a grassroots campaign for it (here and online) and some people have some concerns.
1) Can people grow their own marijuana for recreational purposes if they are over 21 and it is not for sale and for personal use?
Adults over the age of 21 would be able to grow up to 10 plants for personal use (but not for sale) if they are grown outside of public view, as specified. 2) When the bill states that all employees are to have a background check done on them, what is the criteria? Would a previous drug charge bar you? A lot of experienced growers that could help out could be barred if so.It doesn't specify what would be a part of that background check. The regulatory process that would occur after this bill is passed would established what can and can't be considered. However, it should be noted that nonfelonious marijuana possession convictions can't be considered in a background check if more than 2 years old under existing law. 3) I read that there is no consumption on premises of cultivators and wholesalers, what about retailers? Will there be a market for Amsterdam like coffeehouses? 215 patients have them, will recreational users?
While this bill would allow sales of marijuana to happen at a wide variety of places, smoking or otherwise ingesting marijuana would be illegal in all public places including retail establishments, cafes, and even on public streets.
4) I know the first date for discussion is March 26, but can you give me a more detailed idea of how this will go through legislation? Is there an estimated time for a vote for the assembly?
This bill is set to be heard in the Public Safety committee on March 31st. If that committee hearing happens, we will also be expected to testify later this spring in Health Committee and later in the Assembly Appropriations Committee. If we pass all those committees then we will have a chance on the Assembly Floor. If we pass there, we will have to go through the same process again in the Senate before it reaches the Governor to be signed or vetoed. It could take 2 years to reach the Governor's desk.
5) What is adequate security? A fence and cameras? Razor wire and Dobermans?
Adequate security would be defined in the regulatory process. I think Razor wire and Dobermans might be required in some circumstances and a fence might suffice in others.
